1. Agreement to Terms

By accessing or using TextFigaro, a service of Figaro Labs LLC ("Figaro Labs", "Figaro", "Service", "we", "us", "our"), including by sending SMS messages to our phone number, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

TextFigaro is an AI-powered personal assistant accessible via SMS text messaging. The Service uses artificial intelligence to help you manage tasks, lists, reminders, and other personal organization needs through conversational text messages.

The Service is powered by Anthropic's Claude AI technology. Your messages are processed by AI systems to generate responses and perform requested actions.

3. Eligibility

  • You must be at least 13 years of age to use the Service
  • If you are under 18, you represent that you have parental consent
  • You must have a valid phone number capable of sending and receiving SMS
  • You must not be prohibited from using the Service under applicable law

4. User Responsibilities

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to the Service or its systems
  • Transmit malicious code, spam, or harmful content
  • Impersonate another person or entity
  • Use the Service to harass, abuse, or harm others
  • Attempt to reverse engineer, decompile, or extract source code
  • Use automated systems to send messages (bots, scripts, etc.)
  • Resell or redistribute access to the Service

5. AI-Generated Content

Important: Figaro uses artificial intelligence (Anthropic's Claude) to generate responses. While we strive for accuracy and helpfulness:

  • AI responses may contain errors, inaccuracies, or outdated information
  • The Service is not a substitute for professional advice (medical, legal, financial, psychological, etc.)
  • You should independently verify any important information
  • AI responses reflect the technology's capabilities and limitations
  • We do not guarantee that reminders will be delivered at exact times

By using the Service, you acknowledge that you understand and accept the inherent limitations of AI technology.

6. SMS and Messaging Terms

The Service operates via SMS messaging provided by Twilio. By using the Service:

  • You consent to receive SMS messages from TextFigaro
  • Message and data rates from your carrier may apply
  • Message frequency varies based on your usage
  • You can opt out at any time by texting "STOP"
  • Text "HELP" for assistance

Carriers are not liable for delayed or undelivered messages. We are not responsible for carrier charges or fees.

7. Subscription and Billing

Free Tier: Users receive a limited number of messages per month at no cost. Free tier limitations may change at our discretion.

Pro Subscription: Paid subscribers are billed monthly in advance. Subscriptions automatically renew unless cancelled. You may cancel at any time by:

  • Texting "cancel subscription" to Figaro
  • Emailing billing@textfigaro.com
  • Through your account dashboard

Cancellation takes effect at the end of the current billing period. Refunds are provided at our discretion for unused service.

8. Intellectual Property

The Service, including its design, features, and content (excluding user-generated content), is owned by TextFigaro and protected by intellectual property laws.

You retain ownership of any content you create (lists, reminders, etc.). By using the Service, you grant us a license to store, process, and display your content solely to provide the Service to you.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIGARO LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless Figaro Labs LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.

You may terminate your account at any time by texting "delete my account" to Figaro or emailing support@textfigaro.com.

13. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes via SMS or email. Continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Los Angeles County, California.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
